Switzerland Proposes New Act for Taxation

During its meeting on 7 June 2024, the Federal Council initiated the consultation on the Federal Act on the International Automatic Exchange of Information on Salary Data. The Federal Council initiated the consultation on the Federal Act on the International Automatic Exchange of Information on Salary Data during its meeting on 7 June 2024. The consultation will run until 27 September 2024. Switzerland and Italy agreed on new rules for the taxation of cross-border commuters in December 2020. An automatic and reciprocal exchange of information for taxing cross-border commuters in their country of residence has been in place since 1 January 2024. An agreement governing the taxation of remote working was signed between Switzerland and France in June 2023. The agreement introduces an automatic and reciprocal exchange of information for taxing employees working in a different country than they reside in. The Federal Council is proposing a new act to govern the automatic exchange of information on salary data between Switzerland and partner states with corresponding treaties. Employers must provide relevant tax authorities with a record of salary data for employees not residing in Switzerland for each tax period if the exchange is provided for in an international agreement. The proposal for the Federal Act on the Taxation of Remote Working in an International Context is currently being debated by Parliament.
